The petitioner seeks bail in connection with Dumra P. S. Case No.355 of 2021, instituted for the offences under Section 30(a) of the Excise Act, 2016.

The learned counsel for the petitioner submits that the petitioner is in custody since 21.09.2021, charge-sheet has been submitted in this case and has antecedent of six cases. The learned counsel for the petitioner submits that inadvertently in the bail application, it has been recorded that petitioner has antecedent of six cases when petitioner has antecedent of five cases only.

Allegation is of recovery of 179.400 litre of liquor from a pick-up van.

No.69882 of 2021(2) dt.25-02-2022 2/2 The learned counsel for the petitioner submits that petitioner is neither the driver, nor the owner of the pick-up van and had merely taken lift and came to be implicated when search was made without knowing that what was loaded in the said vehicle.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-II-cum-Special Judge, Excise Act, Sitamarhi in connection with Dumra P. S. Case No.355 of 2021.

The application stands allowed.
