2. The petitioner apprehends his arrest in connection with Semra P.S. Case No. 08 of 2024, registered for the offences punishable under Sections 341, 323, 307, 354, 379, 504, 34 of the Indian Penal Code.
3. The specific allegation against the petitioner is that he inflicted spade blow on the frontal portion of the head of the informant. The injury suffered by the informant is grievous in nature as per medical report.
4. The learned counsel for the petitioner has submitted that both the parties are labourers and agnates also. There is a case and counter case and the members of petitioner's side have
Patna High Court CR. MISC. No.62683 of 2024(3) dt.16-12-2024 2/2 also suffered some grievous injury. The petitioner has got no criminal antecedent.
5. On the other hand, learned APP for the State has opposed the prayer for bail.
6. Considering the aforesaid facts, the petitioner is not entitled for privilege of anticipatory bail. His prayer for anticipatory bail is hereby rejected.
7. If the petitioner surrenders before the court below and makes a prayer for regular bail, that shall be disposed of on the same day of its filing, on its own merit without being prejudiced by this order. The learned court below may take into account that the members of petitioner's side have also suffered grievous injury.
8. With these observations, this application is disposed of.
