The petitioner seeks bail in a case registered under Sections 395, 412 of the Indian Penal Code.

Allegation is that the accused persons and 10-12 unknown miscreants holding gun, farsa, knife in their hands surrounded the jeep and caused assault to the driver. The miscreants on the point of weapons looted away cash, ornaments, mobile etc. from the informant and his family members.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 1.6.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not

Patna High Court CR. MISC. No.57255 of 2019(2) dt.11-09-2019 2/2 named in the F.I.R. His name has come on confessional statement of co-accused. There is no recovery of any incriminating article from the possession of the petitioner. The petitioner has not been put on T.I.P.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. VII, Motihari, East Champaran in connection with Turkauliya (Banjariya) P.S. case No.4 of 2014.
