JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-09-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 426 of 2015, disclosing offences under Sections 147, 341, 323, 354, 379, 504 and 506 of IPC.

Prosecution case is of trying to outrage the modesty of the complainant by the petitioner and also of pelting stones and snatching silver chain worth Rs.7000/-.

Submission of the learned counsel for the petitioner is that father of the petitioner has also lodged a police case against the complainant with respect to assaulting the petitioner while he was harvesting the crops in his field. Further submission is that there is a land dispute between the parties and petitioner

Patna High Court CR. MISC. No.55695 of 2019(2) dt.03-09-2019 2/2 happens to be the nephew of the complainant, as such, the allegation as appeared in the complaint petition does not appear to be probable.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M.-I, Banka, in connection with Complaint Case No. 426 of 2015, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
