The petitioner apprehends his arrest in connection with Uchaka Gaon P.S. Case no. 210 of 2018, registered under Sections 341, 323, 324, 379, 354, 504 and 506 of the Indian Penal Code.

The accusation is that occurrence of quarrel and scuffle took place in between the family members of the informant Sanawati Kunwar and Dhanraj Mahto regarding which Panchayati was arranged and both the parties promised not to commit any occurrence in future, but in the night of 22/23.07.2018, Manraj Mahto (petitioner) and Dhanraj Mahto came at the house of informant and started strangulate the informant. Thereafter, informant raised alarm, at that time, both

No.59254 of 2019(2) dt.20-09-2019 2/3 pointed knife at her chest giving threatening to kill her, but in the meantime, children woke up and raised alarm then both attacked on her, but, in course of rescue, the informant received cut injury in her hand and both fled away from there. After sometimes, petitioner along with Dhanraj Mahto, Narad Mahto, Dilip Mahto, Amrita Devi, Urmila Devi and Beby Devi came there and, again, started to cause assault to the informant through lathi and iron rod. At that time, this petitioner torn her clothes and took cash of Rs. 30,000/- from the box of informant.

Learned counsel for the petitioner submits that scuffle took place due to family dispute in which informant sustained injury. Moreover, three injuries found on the person of informant, which are simple in nature caused by hard and blunt substance. The petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-IX, Gopalganj in connection with Uchaka Gaon P.S.
