The petitioner seeks bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 16.08.2021, charge-sheet has been submitted in the case and has antecedent of one case. Learned counsel for the petitioner submits that the informant alleges that he along with his companion were intercepted by 3-4 unknown miscreants who looted the vehicle of the informant along with other articles as detailed in the FIR. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case based

Patna High Court CR. MISC. No.70773 of 2021(2) dt.05-05-2022 2/2 on his confession made before the police in a different case wherein it is alleged that he accepted his participation in the present occurrence. It is further submitted that the petitioner has not been put on TIP nor recovery of any incriminating article has been made from his possession.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 16.08.2021, charge-sheet has been submitted in the case and taking into consideration the submissions made by the learned counsel for the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Bhagwanpur P.S. Case No. 126 of 2021.
