JUSTICE JYOTI SARAN ORAL ORDER 28-10-2016 Heard Mr. Vijay Kumar, learned counsel for the petitioner, and Mr. Neeraj Raj, AC to G.A. VIII, for the State. The petitioner is aggrieved by the order of suspension, bearing Memo No. 13/13-14/1527, dated 19.11.2014, whereby the petitioner has been kept under deemed suspension from the date he was taken into custody in connection with criminal case bearing Dhanarua P.S. Case No. 204 of 2013 until his release on bail on 19.05.2014. The petitioner also questions the second suspension order bearing Memo No. 1528, dated 19.11.2014, whereby the petitioner has, again, been put under

Patna High Court CWJC No.7849 of 2016 (2) dt.28-10-2016 suspension, consequent upon his release on bail on 19.05.2014 and his joining on 20.05.2014, with effect from the date of issuance of the suspension order.

Mr. Neeraj Raj, learned counsel for the State, with reference to the charge memo, present at Annexure 4, submitted that it has already been served on petitioner on 03.08.2015 and that the departmental proceeding would be concluded provided the petitioner would cooperate in its disposal.

Mr. Ranjeet Kumar Pandey, learned counsel for respondents 2 to 6 submits that the departmental proceeding enquiry has concluded and the petitioner has also been served with a second show cause seeking a representation thereon and now only final orders are to be passed upon receipt of the reply from the petitioner.

Having heard the learned counsel for the parties and considering the stage at which the proceeding, presently rests, I deem it fit and proper to dispose off the writ application with a direction to the disciplinary authority to pass final order expeditiously and preferably within six weeks from the date of receipt of the reply of the petitioner to the second show cause, so served upon him.
