2. This is second anticipatory bail petition on behalf of petitioner in connection with Harlakhi P.S. Case No. 119 of 2022 registered for the offence under Sections 363 and 366-A of the Indian Penal Code. Earlier, the petition, filed for grant of anticipatory bail on behalf of petitioner, was dismissed as withdrawn vide order dated 18.05.2023 passed in Cr. Misc. No. 15287 of 2023.

Learned counsel for the petitioner submits that petitioner has renewed her prayer for bail on the ground that during pendency of the case, charge-sheet has already been submitted against the petitioner. Further submission is that petitioner is not named in the FIR. Her name has been transpired during course of investigation only on the ground that she is
Patna High Court CR. MISC. No.63891 of 2024(2) dt.27-09-2024 2/2 mother of co-accused Aditya Kumar Paswan who is alleged to have kidnapped the daughter of informant. Petitioner is living separately with her husband and she has no concern with the occurrence. Petitioner claims clean antecedent.
6. Learned A.P.P. for the State opposed the prayer for bail of the petitioner.

Having considered the fact that specific accusation of kidnapping is against co-accused Aditya Kumar Paswan, so far as this petitioner is concerned, there is no specific allegation against this petitioner, she is a lady and has got clean antecedent, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of eight weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VIII, Madhubani in connection with G.R. No. 74 of 2023 arising out of Harlakhi P.S. Case No. 119 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
