The petitioners seek bail in anticipation of their arrest in connection with Athmalgola P. S. Case No. 139 of 2018 dated 26.06.2018 instituted for the offences under Sections 448, 323, 504, 307 and 34 of the Indian Penal Code.
It has been submitted on behalf of the petitioners that they have been attributed with general and omnibus allegation of assaulting the informant and others. There is a counter version of the occurrence, which was lodged earlier
Patna High Court Cr.Misc. No.3866 of 2019(2) dt.25-01-2019 2/2 than the present case. The injuries suffered by the victim of this case have been opined to be simple in nature. It has further been submitted that the parties are agnates and there is a pre-existing land dispute between them.
Considering the afore-stated facts as also taking into account that the petitioners are persons of clean antecedents, the petitioners, above-named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Barh, District - Patna in connection with Athmalgola P. S. Case No. 139 of 2018, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
