The petitioner seeks bail in Basnahi P.S. Case No. 55 of 2021, registered for the offence punishable under Section 394 of the Indian Penal Code.

As per the FIR, six miscreants on the point of pistol looted cash, mobile, ornaments and other articles from possession of informant.

It is submitted on behalf of the petitioner that petitioner is not named in the FIR. Name of this petitioner has come in this case on the basis of confessional statement of coaccused Rupesh Kumar who has been granted bail by this Court vide order 08.02.022 passed in Cr. Misc. No. 59377 of 2021. No incriminating article has been recovered from possession of this petitioner. No test identification parade has been held till date.

Patna High Court CR. MISC. No.70057 of 2021(2) dt.04-03-2022 2/2 Petitioner is in custody since 24.08.2021. Investigation is complete.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 3rd Additional Chief Judicial Magistrate, Saharsa in connection with Basnahi P.S. Case No. 55 of 2021.
