2. The petitioner seeks regular bail in the present case registered for the offence under Sections 8(c), 20, 21, 22 of the NDPS Act.

3. As per the prosecution case, 10.210 miligrams of smack (heroin) has been recovered from the possession of the petitioner.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 30.06.2024.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Sessions Judge cum Special Judge NDPS Act, Patna/concerned Court below in connection with Bihta P.S. Case No. 577 of 2024 subject to conditions that:- (i). The petitioner will mark his attendance at the Bihta Police Station on every Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.

(ii). The petitioner shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial.
