JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-11-2019 This is an application for grant of anticipatory bail in connection with Sursand P. S. Case No. 212 of 2017, disclosing offences under Sections 147, 341, 342, 353, 385, 323, 504, 506 and 120B of IPC.

As per F.I.R. petitioners and several other accused persons have confined the informant, who happens to be the Headmaster of the School and also assaulted him. Submission of the learned counsel for the petitioners is that they are Members of the Shiksha Samiti and Ward Councilor and they have made some allegation against the Headmaster and as such, they have falsely been implicated in this case, just after the election of the Shiksha Samiti. They are ready to abide by any conditions imposed upon them.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Sub Divisional Judicial Magistrate, Pupri, Sitamarhi, in connection with Sursand P. S. Case No. 212 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
