The petitioner seeks bail in a case registered under Sections 363, 366A of the Indian Penal Code. The prosecution case in brief is that the informant's daughter was kidnapped by the accused persons. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 18-01-2018. Charge sheet has already been submitted. Earlier prayer for bail of the petitioner was rejected vide paragraph-1 of the bail application. The petitioner is in custody since 18-01-2018. Charge was framed on

Patna High Court CR. MISC. No.5795 of 2019(3) dt.15-04-2019 2/2 16-03-2018. Thereafter, none of the prosecution witness has turned up for their evidence. There is no likelihood of the trial being concluded in near future. The main allegation is against co accused namely Sikandar Singh. No sexual abuse is alleged against the petitioner. The petitioner has remained in custody for more than a year.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Vaishali at Hajipur in connection with Sessions Trial No. 92 of 2018 arising out of Desri P.S.
