2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 379, 307, 504, 506 of the Indian Penal Code.

3. As prosecution case, the allegation against the petitioner is that he along with co-accused namely, Saurav and Alok caught hold the informant and petitioner gave knife blow on the right side of his chest.

4. It is submitted by learned counsel for the petitioner that petitioner is innocent and has falsely been implicated in this case. The real fact is that the informant was creating nuincense during Barat in drunken stage and he fell down in intoxicated condition and got injury and taking advantage of the same the present case has been filed. Petitioner was not present in the

Patna High Court CR. MISC. No.63302 of 2023(2) dt.19-10-2023 2/2 village on the alleged date of occurrence and due to dirty village politics the petitioner has been implicated in the present case. The injury sustained by the informant is simple in nature. Petitioner has no criminal antecedent as mentioned in para-3 of this application.

5. Learned APP for the State opposes prayer for anticipatory bail.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned lower Court where the case is pending/successor Court in connection with Nemdarganj P.S. Case No. 13 of 2023, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
