The petitioner seeks pre-arrest bail in connection with Atri P.S.Case No. 115 of 2017 registered under Section 7 of the Essential Commodities Act.

It is submitted by the learned counsel for the petitioner that on 14.06.2017 the petitioner had opened the shop and notice board was also displayed on the shop. The petitioner was not given any information regarding inspection of the shop and no show cause was ever asked from him before cancellation of his license. He submitted that most of the beneficiaries attached to the shop of the petitioner have no grievance and the petitioner is being prosecuted in the present case merely on malicious

Patna High Court Cr.Misc. No.59275 of 2017 (2) dt.13-12-2017 2/2 allegations made by some beneficiaries with vested interest. Learned counsel for the State opposed the prayer for grant of pre-arrest bail.

Regard being had to the nature of allegation and the submissions made above, in the event of arrest or surrender before the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Gaya in connection with Atri P.S.Case No. 115 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
