The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 307, 290, 427, 337, 338 of the Indian Penal Code and Section 27 of Arms Act.

As per prosecution case, it is alleged that some unknown miscreants made firing to create terror and broke the glasses of the bus and safari jeep of owner of Krishna Rath. The miscreants thereafter fled away with

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The F.I.R was lodged against unknown and the petitioner has falsely been implicated in this case on the basis of confessional statement of other co-accused which has no evidentiary value in the eye of law. The informant is not the eye witness to the occurrence and no one has sustained any injury in the occurrence. The petitioner is languishing in judicial custody since 25.3.2023. Learned APP appearing for the State has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail.
