JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-01-2019 The petitioners apprehend their arrest in connection with Kesariya P.S.Case No. 353 of 2018 registered under Sections 323, 327, 341 and 384/34 of the Indian penal Code and 27 of the Arms Act.
Allegation against the petitioners and other accused persons is of opening fire and tried to grab the land and also of making demand of Rangadari.
Submission of learned counsel for the petitioners is that there is land dispute between the parties and earlier the Sub Divisional Officer has referred the matter for initiating a proceeding under Section 144 Cr.P.C. and the case of demand of
Patna High Court Cr.Misc. No.2296 of 2019(3) dt.22-01-2019 2/2 Rangadari is false and concocted and nobody has received injury.
Heard learned APP also.
Having heard both sides and in the facts and circumstances, as stated above, let the petitioners, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, East Champaran, Motihari in connection with KesariaP.S. Case No. 353 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
