The petitioner seeks bail in anticipation of his arrest in connection with Chanpatia (Sirisia O.P.) P. S. Case No. 339 of 2018 dated 07.08.2018 instituted for the offences under Sections 467, 468, 471 and 414 of the Indian Penal Code and Section 30(A)/30(B) of the Bihar Prohibition and Excise Act, 2016.
The F.I.R. discloses that on raid in the house of some of the villagers in village Garabhuwa Tola, liquor from some houses and one motor-cycle from the house of the
Patna High Court Cr.Misc. No.2165 of 2019(2) dt.16-01-2019 2/3 petitioner was recovered.
Learned counsel for the petitioner submits that the implication of the petitioner in this case is only on the basis of guess work of the raiding team. The motor-cycle which is said to have been recovered from the house of the petitioner is not a stolen motor-cycle.
The petitioner has clean antecedents.
Under similar circumstances, one of the accused persons namely Rajendra Sah has been granted anticipatory bail by a Bench of this Court vide order order 11.01.2019 passed in Cr. Misc. No. 78846 of 2018.
For the aforesaid facts, the petitioner, abovenamed, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Bettiah, West Champaran in connection with Chanpatia (Sirisia O.P.) P. S. Case No. 339 of 2018,
Patna High Court Cr.Misc. No.2165 of 2019(2) dt.16-01-2019 3/3 subject to the conditions as laid down under Section 438 (2) Cr.P.C.
