2. The petitioner is in judicial custody in connection with Mahnar P.S. Case No. 275 of 2023 instituted under Sections 323, 341, 324, 379, 307/34 of the Indian Penal Code lodged on 25.9.2023 by the informant, Jageshwar Sahni.
3. As per the prosecution story, the informant alleged that when he was going to take a bath, heard noise and came out side found the accused persons abusing Reeta Devi (daughter) as also Surya Devi (daughter-in-law). Upon objecting to the said abuse, the petitioner no.1 Pramod Sahni attacked Reeta Devi and Surya Devi with sword causing injury on the head, when he tried to snatch the sword, the hand was also injured. Further allegation against Sunita Devi, petitioner no.2 is of attacking informant's brother, Baleshwar Sahni causing injury. The

4. Learned counsel for the petitioner submits that he has already suffered by being in custody since 02.05.2024 on the ground that the injury inflicted by him was grievous in nature, if granted relief, he shall be diligently appearing in trial.
5. Learned APP opposes the prayer stating that earlier the application was rejected.
6. Considering the submissions of the parties as also his period of custody and the fact that he has undertaken to diligently appearing in trial, this Court is inclined to extend him the privilege of bail with conditions.
7. Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned J.M.1st Class, Vaishali at Hajipur, in connection with Mahnar P.S. Case No. 275 of 2023 subject to the following conditions: (i) one of the bailor should be the family member/relative of the petitioner who shall provide official document to show his bona fide;
(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive

(iii) the petitioner shall appear before the concerned police station every fortnight for next six months to mark his attendance;
(iv) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(v) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) Ravi/- U T
