Sumitra Kunwar v. The State Of Bihar And ORS
Patna High Court CR. REV. No.1182 of 2012 (4) dt.23-02-2015
IN THE HIGH COURT OF JUDICATURE AT PATNA
Criminal Revision No.1182 of 2012 ====================================================== Sumitra Kunwar .... .... Petitioner/s
Versus
The State of Bihar & Ors .... .... Respondent/s ====================================================== Appearance :
For the Petitioner/s : Mr. Chandra Mohan Jha For the Respondent/s : Mr. Nagendra Prasad (App) ====================================================== CORAM: HONOURABLE JUSTICE SMT. ANJANA PRAKASH ORAL ORDER 23-02-2015 The petitioner seeks revision of the judgment of acquittal passed by the Additional Sessions Judge III, Ara in Cr. Appeal No. 24 of 2000 dated 20.09.2012.
I find that it was on account of delayed reporting of the occurrence that the appeal was allowed and hence finding no perversity in the judgment, it is dismissed. It is submitted that since this application has been dismissed the opposite parties will capture the lands upon which the petitioner is living.
Considering that this Court is not passing any order on the title of the parties, the application is disposed of with liberty to the petitioner to approach the authority concerned if at all the accused persons attempt to dispossess him.
