This application, for grant of anticipatory bail, arises out of Supaul S.C./S.T. P.S. Case No.05/2016, disclosing offences under Sections 341, 323, 504 and 506 of the Indian Penal Code and Section 3(i) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

Learned counsel, appearing on behalf of the petitioner, appears to be right in his submission that no offence under the provisions of Scheduled Castes and

Patna High Court Cr.Misc. No.18131 of 2016 (4) dt.21-07-2016 2/3 Scheduled Tribes (Prevention of Atrocities) Act, is made out against the petitioner on the basis of what has been alleged in the First Information Report. He contends that it is evident from the First Information Report that some dispute between the petitioner and the informant, who is a police constable, caused annoyance to the informant, leading to lodging of the First Information Report. A supplementary affidavit has been filed on behalf of the petitioner stating his criminal antecedent. Considering the facts and circumstances of the case, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.

10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Supaul, in connection with Supaul SC/ST P.S. Case No.05 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner, above named, shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before
