JUSTICE SANJAY PRIYA ORAL ORDER 06-12-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Danapur P.S. Case No. 311 of 2017 instituted for the offence under Sections 341, 323, 406, 420, 504 and 506/34 of the Indian Penal Code. It is alleged in the written report that this petitioner along with two other accused persons entered into agreement with complainant for a piece of land and received total amount of Rs.80,11,000/-. When the informant reached Registry Office at the time of execution of sale deed, then he was informed by the Registrar that the injunction has already been ordered by the court with regard to sale of that plot. Therefore, registry cannot be done.
Patna High Court Cr.Misc. No.56879 of 2017 (2) dt.06-12-2017 2/2 Thereafter, the informant made request to the petitioner and other accused persons to return the money, but they always avoided and gave threat to the informant.
The agreement is part of the written report which also bears the acknowledgment of petitioner and other accused persons of receiving the amount by the informant on different dates. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.
Prayer for anticipatory bail of the petitioner stands rejected.
Petitioner may surrender before the court below and make prayer for regular bail.
