JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 09-03-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P for the State.

The petitioner seeks bail in a case for the offences punishable under sections 272 and 273 of the I.P.C, sections 25 (1B) a and 26 of the Arms Act and section 47 (a) of the Excise Act. Allegedly, from the grocery shop of the petitioner one country made rifle with magazine, two live cartridges and 100 bottles of country made liquor each containing 200 ml. were recovered and for that the petitioner is in custody since 17.09.2015 having no criminal antecedent.

In the facts and circumstances as stated above, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like

Patna High Court Cr.Misc. No.58336 of 2015 (3) dt.09-03-2016 2/2 amount each to the satisfaction of C.J.M. Nawada in Nawada P.S. Case No. 611 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
