Heard learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends arrest in connection with Chanpatiya (Sirisiya O.P.) P.S. Case No. 577 of 2023 instituted under Sections 302/201/120B of the Indian Penal Code.

As per the prosecution case, initially F.I.R. was registered against two persons for the murder of Radheshyam Giri. And subsequently during investigation, the name of the petitioner has come.

It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case merely on the ground of confessional statement of one co-accused Sharma Giri.

Learned APP appearing for the State has vehemently opposed the prayer for anticipatory bail. 6.

Having heard learned counsel for the parties and further considering the fact that there is no direct evidence against the petitioner in the case diary to reveal his complicity in the alleged occurrence and further considering that coaccused Akash Giri and Shyamsundar Giri have been granted bail vide orders dated 20.07.2024 and 28.06.2024 by a Coordinate Bench of this Court in Cr. Misc Nos. 32434/2024 and 25472/2024, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Chanpatiya (Sirisiya O.P.) P.S. Case No. 577 of 2023, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
