Petitioners apprehend their arrest in Bhargama P.S. Case No.27 of 2018 registered under Sections 341, 323, 325, 427, 379, 504, 506 and 34 of the Indian Penal Code. The informant alleged that petitioner no.1 was cutting the bamboo of the informant. His younger brother Arun Kumar Mandal forbade him on such Mahendra Mandal, Sanjay Mandal and Ranjit Mandal, Godawari Devi, Ranju Devi came and began to abuse him. They also assaulted the informant, brother and other family members of the informant.

Learned counsel for the petitioners submits that

Patna High Court CR. MISC. No.55197 of 2019(2) dt.04-09-2019 2/2 Mahendra Mandal (petitioner no.1) is uncle of the informant and petitioner nos.2 and 3 are sons of Mahendra Mandal. Some altercation took place on account of cutting of bamboo. Both sides were claiming the bamboo to be their own. Omnibus and general allegation of assault is made that too on account of land dispute.

Having considered the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Araria in connection with Bhargama P.S. Case No.27 of 2018 (G.R. No.392 of 2018) subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
