The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 399, 411, 414 of the Indian Penal Code and Sections 25(1-b)a, 26, 35 of the Arms Act.

Prosecution case relates to recovery of one loaded country made pistol and mobile phone from the possession of this petitioner, as per the seizure list.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case on the basis of suspicion. Petitioner has no concern with the recovery of pistol and nothing incriminating article has been recovered from his

Patna High Court CR. MISC. No.58280 of 2022(2) dt.18-01-2023 2/2 conscious possession. During course of investigation, no any cogent material found against the petitioner. It is further submitted that the petitioner is languishing in judicial custody since 23.2.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Phulparas P.S. Case No. 93 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Jhanjharpur, Madhubani.
