The petitioner apprehends his arrest in Siwan Muffasil P.S. Case No. 339 of 2021, registered for the offences punishable under Sections 354(B), 308 and other allied sections of the Indian Penal Code.

As per the prosecution case, this petitioner tried to outrage the modesty of informant. when mother of the informant went to the house of petitioner to make complain, it is alleged that father of petitioner assaulted her by bamboo on her head, as a result of which she sustained injury.

It is submitted that no such occurrence has ever taken place. Petitioner and informant are Pattidars. Informant is cousin sister of this petitioner. As a matter of fact, on the alleged

No.69737 of 2021(2) dt.19-07-2022 2/2 date of occurrence, father of petitioner was removing sand from his land, in the meantime, Uday Kumar Ram brother of informant came and assaulted him for which father of petitioner filed complaint case bearing No. 851 of 2021 in the Court of Chief Judicial Magistrate and in order to save their skin this false case has been lodged by the informant against petitioner. Injuries sustained by the mother of informant is reported to be simple in nature.

Considering the backdrop in which the alleged occurrence took place and the nature of injury, the petitioner above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Siwan Muffasil P.S. Case No. 339 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
