JUSTICE SUDHIR SINGH ORAL ORDER 17-03-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 302 and 120B of the Indian Penal Code and Section 27 of the Arms Act.
Allegation against the petitioners is of killing husband of the informant due to some petty reason.
It is submitted on behalf of the petitioners that they have got no criminal antecedent. They have been named merely on the basis of suspicion. There is no eye witness to the alleged occurrence nor there is any circumstantial evidence to suggest implication of petitioner in the present case. On behalf of the State, it is submitted that petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each
Patna High Court Cr.Misc. No.56611 of 2015 (3) dt.17-03-2016 2/2 with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with Sadar P.S.
