1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Jehanabad P.S. Case No. 449 of 2025 registered for the offences punishable under Sections 310(2) and 317(3) of the BNS, 2023.

3. Learned counsel for the petitioner submits that petitioner has antecedent of one case and the informant alleges that he runs a company in the name of Maa Infratech Private

No.66813 of 2025(3) dt.15-10-2025 2/3 Limited and the company was doing the work of shifting of tower near Patna-Gaya-Dhobhi NH-83 and on 05.6.2025 he was informed by his staff that 15-16 accused in the age group of 2025 and 30-35 years came who were talking in local dialect and looted two tractors along with several articles as detailed in the FIR.

Learned counsel for the petitioner submits that FIR was against unknown and one Biru based on CDR investigation came to be arrested and Biru in confessional statement named the petitioner and other accused of having participated in the occurrence. It is next submitted that name of the petitioner transpired in the confessional statement of Biru in police custody which does not have any evidentiary value.

Learned A.P.P. for the State vehemently opposes the anticipatory bail application and submits that informant is a businessman and the FIR was instituted against unknown that they looted tractor and other articles which were kept in the godown for performing the work. It is next submitted that of late in the State of Bihar, the criminals are indulging in such activities frequently. It is further submitted that Biru was arrested based on his CDR investigation and it was in his confession that name of the petitioner transpired and

Patna High Court CR. MISC. No.66813 of 2025(3) dt.15-10-2025 3/3 investigation is continuing and if privilege of anticipatory bail is granted to the petitioner, the petitioner may abscond.

6. Considering the submissions made by the learned APP for the State, the Court is not inclined to extend the privilege of anticipatory bail to the petitioner.

7. Accordingly, the instant anticipatory bail application stands rejected.
