The petitioners apprehend their arrest in Pakribarawan P.S. Case No.129 of 2017 registered under Sections 366, 366(A), 368, 376 of the Indian Penal Code read with Section 4 of the POCSO Act.
The informant filed complaint case alleging therein that Akhilesh Ravidas, the sons of the petitioners with the help of the petitioners kidnapped his minor daughter.
The learned counsel for the petitioners submits that there is no allegation against the petitioners. Victim made her statement under Section 164 of the Cr.P.C. and disclosed that Akhelesh Ravidas forcibly kidnapped her and put Sindur on her head. The
Patna High Court Cr.Misc. No.63563 of 2017 (2) dt.11-01-2018 2/2 learned counsel for the petitioner further submits that petitioner are mother and father of Akhelesh Ravidas.
It appears that even victim did not make any allegation of kidnapping against the petitioners. She had alleged that the mother and brother of Akhilesh Ravidas abused her and ousted her from their house.
Considering the facts aforesaid and the nature of allegation made against the petitioners, the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from the date of receipt / production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge, Nawada in connection with Pakribarawan P.S. Case No.129 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
