The contention on behalf of the petitioner is that the total area of Plot No.1840 was 3.52 acres and out of the aforesaid area 0.83 decimal land was earlier sold to Madanlal Hembrum and others and the rest area was sold to the complainant, but complainant suspected that there was less area on the spot as a result of which he filed the present complaint case. It is submitted even if the prosecution case assumed to be true, then also it is a dispute of civil nature. Considering the aforesaid facts and circumstances as well
