JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-11-2019 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Singhwara P.S. Case No. 57 of 2019 registered for the offences punishable under Sections 363, 366A, 504/34 of the Indian Penal Code.
The perusal of the record goes to show that petitioenrs were granted privilege of anticipatory bail provisionally vide order dated 19.09.2019 by a co-ordinate Bench of this Court.
However, the first information report reflects that when the informant in search of his daughter went to the village of the petitioners, the petitioners and others disclosed that the
Patna High Court CR. MISC. No.59145 of 2019(3) dt.20-11-2019 2/2 victim was taken away by F.I.R named accused Anil Paswan. Admittedly, the victim has already returned to her home and even if, it assumed to be true, that the victim was minor at the time of alleged occurrence, then also, there is nothing on the record to show that the petitioners had kept the victim in their house.
In view of the aforesaid facts as well as submissions of the parties, the order dated 19.09.2019, is hereby, confirmed.
Accordingly, this anticipatory bail petition s tands disposed of.
