The petitioner seeks Anticipatory bail in connection with Bochahan P.S. Case No. 165 of 2017 registered under Sections 363 and 365 of the Indian Penal Code.
The allegation against the petitioner is of kidnapping of daughter of the informant.
Learned counsel for the petitioner submitted that petitioner is not named in the FIR and she is a lady studying at S.N.S. College, Muzaffarpur. It has been further submitted that father of the petitioner living in his Sasural because his father in law has got no son, but the neighbour has greedy eye to over his property due to this reason, petitioner has falsely been implicated after the lapse of 6 days of the occurrence. No.180 of 2018(3) dt.17-02-2018 2/2 further been submitted that statement made under Section 164 of the Cr.P.C. only allegation against petitioner, namely, Suruchi Kumari is that she gave a mobile number of the Muna Kumar. Except this statement nothing is on record to show against the petitioner and petitioner has no criminal antecedent. Considering the facts and circumstances of the case, prayer of Anticipatory bail of the petitioner is allowed and petitioner named above in the event of arrest of surrender before the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Muzaffarpur, in connection with Bochahan P.S. Case No. 165 of 2017.
