The petitioners apprehend their arrest in connection with Paharkatta P.S. Case No. 30 of 2019, registered under Sections 149, 148, 341, 353, 323, 379, 511, 504 and 332 of the Indian Penal Code. The accusation is that on receiving information about murder at Kanpur Kacchu Badi, the informant sent to ASI, Ramni Mohan Jha and other police personnel, from where, the dead body was brought to the police station. In the meantime, information was received that Mahmood Alam had committed the murder, who concealing himself at the residence of Ex-Mukhiya Akthar Hussain. Thereafter, police party reached there and saw that members of

No.59035 of 2019(2) dt.19-09-2019 2/2 unlawful assembly started to scuffle with the police party and tried to snatched their arms but anyhow, police party apprehended Mahboob Alam and bought him at the Police Station. At that time, four persons were identified including the petitioners, who were indulg in instigating the mob to create nuisance with the police party. Learned counsel for the petitioners submits that while the petitioners are named in the F.I.R. but no specific overt act has been attributed against them, in fact, due to dirty village politics, the name of the petitioners have been disclosed by the local Choukidar. The petitioners have no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Learned J.M. Ist Class, Kishanganj, in connection with Paharkatta P.S. Case No. 30 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
