JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 25-01-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor, appearing on behalf of the State. This application for grant of anticipatory bail arises out of Forest Case No. 84 of 2013, disclosing offences under Section 33 of the Forest Act and Section 2 of the Forest Protection Act. Learned counsel for the petitioners submits that these petitioners have been implicated merely on the basis of the names furnished by the villagers and there is no incriminating material worth evidence showing involvement of these persons. Considering the nature of accusation and the submissions

Patna High Court Cr.Misc. No.58064 of 2015 (2) dt.25-01-2016 advanced on behalf of the petitioners, this application is allowed. Let the petitioners, above named, in the event of their arrest/surrender before the Court below within six weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in Forest Case No. 84 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
