JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 29-01-2016 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners seek pre-arrest bail in connection with Complaint Case No. 397 of 2014 in which cognizance has been taken under Sections 420, 323 and 504 of the Indian Penal Code.
It has been contended that save and except oral allegation, there is no documentary proof to substantiate the allegation made in the complaint.
Patna High Court Cr.Misc. No.57698 of 2015 (2) dt.29-01-2016 2/2 Regard being had to the nature of allegation and also the fact that the petitioners are said to be men of having roots in the society, in the event of arrest or surrender before the court below within six weeks from today, they are directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in Complaint Case No. 397 of 2014, Trial No. 3016 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
