A counter affidavit has been filed by respondent No.5, namely, the Superintendent of Police, Saran at Chapra, which reveals that several cases are pending between the informant and the accused of Khaira P.S. Case No.37 of 2016. This apart, according to the counter affidavit, no witness has yet been found, who could claim to have seen the accused persons having fired

Patna High Court Cr. WJC No.404 of 2016 (5) dt.21-07-2016 2/2 upon the informant and that there are cases lodged by both the sides against each other and investigation is still pending. Having considered the averments made in the writ petition and materials on record and upon hearing the parties, it is hereby directed that respondent No.5, namely, the Superintendent of Police, Saran at Chapra, shall enquire into the grievances raised in the writ petition, do the needful in accordance with law and get the investigation of Khaira P.S. Case No.37 of 2016 completed expeditiously, preferably, within a period of six months, ensuring proper, fair and effective investigation in such a way that no innocent person is harassed and necessary security of the petitioner is taken care of.

With the aforesaid observations and directions, this writ petition stands disposed of.
