The petitioner apprehends his arrest in Jakkanpur P.S. Case No.442 of 2019 (Special Case No.6268 of 2019), registered under Sections 273 of the Indian Penal Code as well as under Section 30(a) of the Bihar Prohibition and Excise Act. The name of the petitioner figured in the case on the basis of the disclosure made by Pankaj Kumar that the petitioner used to bring liquor but petitioner was neither apprehended on the spot nor liquor was recovered from possession of the petitioner. Pankaj Kumar and Sujit Kumar were apprehended and about 14.6 litres of liquor was recovered from possession of Pankaj Kumar and Sujit Kumar but nothing has been recovered from possession of the petitioner.
Taking into consideration the facts aforesaid that
Patna High Court CR. MISC. No.58226 of 2019(2) dt.18-09-2019 2/2 nothing has been recovered from possession of the petitioner, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Jakkanpur P.S. Case No.442 of 2019 (Special Case No.6268 of 2019), subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
