2. The petitioner is apprehending his arrest in connection with Mahila P.S. Case No. 36 of 2024 for the offence under Sections 341, 323, 498(A), 494, 504 and 506 of the I.P.C.
3. As per the prosecution story, the informant has alleged that her marriage with the petitioner was solemnized on 01.06.2012, according to Hindu rituals. After the marriage, she lived in her in-laws' house and gave birth to two children. Subsequently, the petitioner allegedly
Patna High Court CR. MISC. No.61481 of 2025(6) dt.24-12-2025 2/3 demanded an additional dowry of Rs. 3,00,000/-, upon refusal, he married another woman namely Sonam Kumari, and subjected the informant to mental and physical cruelty.

Vide order dated 25.11.2025, on the basis of undertaking given by petitioner - Rupesh Kumar, a time was given to him on his assurance that he would keep his wife and two minor children along with him at the place of his posting i.e. Murshidabad with full honour and dignity, despite of that, he didn't take them with him.
5. Petitioner has virtually violated his own undertaking and order of this Court which was passed on 25.11.2025. Petitioner has also admitted that he has performed second marriage with another woman namely, Sonam Kumari during the lifetime of his first wife. From perusal of the impugned order, it is apparent that processes under Section 82 of the Cr.P.C. has also been initiated against the petitioner and for this reason also this anticipatory bail application is not maintainable.
6. Keeping in view the aforesaid facts, this Court is not inclined to extend him the privilege of anticipatory bail and accordingly the instant application stands rejected.

7. The petitioner is directed to surrender before the learned Court below and pray for regular bail. The same may be considered by the Court below, on its own merit, without being prejudiced by the order of this Court. (S. B. Pd. Singh, J) Ankit Kumar/- U T
