JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 10-01-2018 Heard learned counsel for the petitioners and the learned counsel for the State.

This application has been filed by the petitioner for modification in the order dated 01.04.2015 passed in Criminal Misc. No. 38107 of 2014 by this court with regard to extend the period of surrender of the petitioner in the court below. Learned counsel for the petitioner submits that vide order dated 01.04.2015 passed in Criminal Misc. No. 38107 of 2014, the petitioners were granted anticipatory bail, in the event of arrest or surrender before the court below, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the 3rd Additional Sessions Judge, Muzaffarpur, in connection with Ahiyapur P.S. Case No.

Patna High Court Cr.Misc. No.38 of 2018 (2) dt.10-01-2018 425 of 2010 and S. Tr. No. 433 of 2014, subject to the conditions laid down under Section 438(2) Cr.P.C. But the petitioner could not surrender within the stipulated period due to personal difficulties. In that view of the matter, learned counsel for the petitioners prays for extension of period of surrender of the petitioners in the court below.

Considering the submission of the learned counsel for the petitioners, the period of surrender of the petitioners in connection with the aforesaid case in the court below is further extended for four weeks from today and this applications is, accordingly, allowed with the aforesaid modification in the order dated 01.04.2015 passed in Criminal Misc.
