The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 380/34 of the Indian Penal Code.

The prosecution case in nutshell is that informant received a call that some boys have entered the house and have created fuss. It is also alleged that when he reached his house then saw that hinge of the gate is broken and everything was scattered. Petitioner

Patna High Court CR. MISC. No.58651 of 2022(2) dt.02-02-2023 2/3 found that his laptop, golden chain, and Rs, 25,500/- cash were missing. It is further alleged that petitioner and one co-accused persons were hiding in the room. It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. It is also submitted that neither the petitioner was present at the place of occurrence nor any incriminating article has been recovered from his conscious possession. It is further submitted that petitioner is languishing in judicial custody since 17.06.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and after considering the period of custody and nature of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be
