JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 29-04-2016 Heard learned counsel for the petitioner, learned counsel for the informant and the learned A.P.P. for the State. The petitioner is accused in connection with Rajapakar P.S. Case No. 173 of 2015, registered under Section 302, 201/34 of the Indian Penal Code.

The prosecution case is that on 07.12.2015 Ankit Kumar, brother of the informant, had gone to do job in Reliance Company, but he did not return. On 28.12.2015, informant received message on mobile from Barati O.P. that dead body of his brother is lying near Kashipur Chakbibi, then informant went there and saw the dead body of his brother. The informant raised suspicion against officials of HFCL tower saying that his brother told him that he had to go to Patna with the officials of

Learned counsel for the petitioner submits that, in fact, the petitioner was not doing job with the brother of the informant and mere on suspicion after lodging the F.I.R, informant gave an affidavit stating that he was informed by one Arjun Rai about lying of the dead body of his brother in Sadar Hospital and informant raised suspicion against the petitioner. The petitioner having no criminal antecedent is in custody since03.01.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-VII, Vaishali at Hazipur in connection with Rajapakar P.S.
