The petitioner seeks bail in a case registered under Sections 147, 148, 149, 325, 307, 302 of the Indian Penal Code. Allegation is that the accused persons including the petitioner reached at the house of the informant to grab the land and in that course, they caused injury to Ashok Yadav, Subhash Yadav and Badki Devi by garasa. Later on, Ashok Yadav died in course of treatment.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 21.06.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. General and omnibus allegation has been

Patna High Court CR. MISC. No.57694 of 2019(2) dt.23-10-2019 2/2 made. Neither any specific overt act is alleged against the petitioner nor any specific injury is attributed against the petitioner. Co-accused have been granted bail vide Cr.Misc.No.34184 of 2013 and Cr.Misc.No.34221 of 2013. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Nawada in connection with Kawakole P.S. case No.51 of 2013.
