JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-09-2019 Petitioner seeks regular bail in connection with Lakhisarai (Ramgarh Chowk) P. S. Case No. 343 of 2018, registered for the offence punishable under Section 392 of IPC. Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 29.11.2018 passed in Criminal Misc. No.68047 of 2018.

It further appears from the record that petitioner has also filed a S.L.A. (Criminal) before the Hon'ble Apex Court, but later on, he seeks permission to withdraw the same, and accordingly the S.L.A. filed by the petitioner was dismissed as withdrawn, which will appear from Annexure 2. Allegation of recovery of one stolen car from the Sasural of the petitioner.

Having heard both sides, considering the fact that petitioner has remained in custody for about more than one year and up till now the charge has not been framed, let the petitioner, above named, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai, in connection with Lakhisarai (Ramgarh Chowk) P. S. Case No. 343 of 2018 with condition that one of the bailor should be the local person, having sufficient property within the jurisdiction of the court concerned and with further condition that if the trial court is fixed the date for framing of charge, he has to appear before the trial court and with further condition that he has to co-operate in disposal of the commitment proceedings as well as framing of the charge against him and other accused persons, otherwise his bail bonds shall be cancelled.

With the above observations, this application is allowed.
