2. The petitioner seeks bail in a case registered for the offence punishable under Section 307 of the Indian Penal Code and Sections 27 of the Arms Act.

3. Petitioner is said to have fired upon the informant due to which he sustained injury.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that there is neither any injury report on record nor the police upon getting a report of firearm injury attempted to get an injury report of the informant. He submits that the FIR was lodged after one month of the said occurrence which makes it clear that the prosecution story is false and concocted one. He

Patna High Court CR. MISC. No.61833 of 2024(2) dt.23-08-2024 2/2 further submits that petitioner has three criminal antecedent as stated in para-3 of the bail application and he is languishing in judicial custody since 08.04.2024.

5. Learned APP for the State opposes the prayer for bail.

6. Considering the nature of offence, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail is rejected in connection with Ranitalab P.S. Case No. 246 of 2022.

7. However, petitioner is at liberty to renew his prayer for bail after framing of charge.
