JUSTICE RAKESH KUMAR ORAL ORDER 25-08-2015 Heard Sri Alok Kumar Sinha, learned Senior Counsel, who appears on behalf of the petitioner and learned AC to AAG14. The petitioner, invoking writ jurisdiction of this Court under Article-226 of the Constitution of India, has prayed for directing the Respondents to give benefit of ACP Scheme with effect from 09.08.1999. The relief has been sought for on the ground that other similarly situated Panchayat Sewak were granted the benefit under the Scheme ignoring the case of the petitioner. However, on perusal of the record, it is evident that without demanding justice, the petitioner has directly approached this Court and, as such, instead of passing any positive order, it is
Patna High Court CWJC No.12241 of 2008 (2) dt.25-08-2015 2/2 desirable to dispose of the writ petition granting liberty to the petitioner to first demand of justice before the authority concerned. If such request it made by the petitioner within a period of six weeks from today, the authority concerned may examine the same and pass appropriate order in accordance with law within a period of three months from the date of filing of such representation.
With above observation and direction, the writ petition stands disposed of.
