The petitioner is apprehending arrest in a case registered for the offences punishable under sections 379 and 420 of the Indian Penal Code and sections 4 and 10 of the Bihar Conduct of Examination Act.

It is alleged that the petitioner and one Ranjeet Kumar, while appearing at the examination for selection of constable at S.S. College, Jehanabad, indulged in use of unfair means and took away carbon copy of the answer book and question paper from the examination centre.

It is submitted by the learned counsel for the petitioner that for the occurrence of 19.10.2014 the FIR was

Patna High Court Cr.Misc. No.57202 of 2015 (2) dt.18-12-2015 2/2 registered on 3.4.2015 and similarly situated co accused has been granted anticipatory bail vide Cr. Misc. No. 39786 of 2015 by coordinate bench of this court on deposit of rupees five thousand before the learned court below.

Considering the delayed lodging of the FIR, it is a case for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Jehanabad P.S. Case No. 147 of 2015 pending in the court of learned CJM, Jehanabad. This application is disposed of with the aforesaid observation/direction.
