JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-03-2019 The petitioner apprehends his arrest in connection with Bairiya P.S.Case No. 340 of 2018 registered under Sections 147, 148, 149, 307, 323, 324, 337, 338, 341, 353, 427 and 504 of the Indian penal Code.
Allegation against the petitioner is of assaulting to the informant who is a police personnel, causing injury to him. Submission of learned counsel for the petitioner is that FIR of the present case shows that police reached in the house of Pawan Kumar with respect to an occurrence which is of 02.09.2018 and there is land dispute between Pawan Kumar and the petitioner and informant taking side of Pawan Kumar, lodged this false and concocted case.

Having heard both sides and in view of nature of
Patna High Court CR. MISC. No.2819 of 2019(3) dt.07-03-2019 2/2 allegation and also injury which appears to be grievous in nature, I am not inclined to grant privilege of anticipatory bail to him rather he should surrender within a period of six weeks from the date of receipt of a copy of this order and make prayer for regular bail, which shall be considered and disposed of on its own merit without being prejudiced by this order.
