JUSTICE MOHIT KUMAR SHAH ORAL ORDER 29-03-2024 The present writ petition has been filed seeking the following reliefs:- "i. For a direction to the Respondents to make an appointment of the Petitioners on the basis of examination conducted by the Staf

Patna High Court CWJC No.20598 of 2021(2) dt.29-03-2024 2/3 Selection Commission for the post of Enforcement Sub Inspectors held on 26/02/2012.

ii. For a direction commanding upon the Respondent No.2 & 3 to declare the cut of marks.

Iii.

For a direction commanding upon the Respondent No. 2 & 3 to produce the answer books of the candidates who has been appointed/selected illegally/Omr sheets of the candidates as well as all the relating papers before this Hon'ble Court for considering the Petitioner's claim.

iv. After verification of Answer Books of the candidates if any illegality or irregularity found in the answer books the fresh examination in the matter may be conducted after cancelling the examination.

V. For a direction to the Respondents not to proceed with in conducting physical test and interview on the basis of the result published in the News paper Hindustan on 09/11/2012 and 25/11/2012.

vi. Alternative prayer of the petitioners for directing to the Respondents Commission to re-evaluate Answer Books and publish a fresh result according to the marks sheet.

vii. During pendency of this Writ application the Respondents may be restrained from

viii. Pass any other orders/directions as your Lordships may deem fit & proper and for which the petitioners are found entitle to in the facts and circumstances of the case and in accordance with law.

ix. To stay the advertisement no. 2 of 2019 published on 03/12/2019 for the post of enforcement Sub- Inspector Govt. of Bihar Transport Department."

At the outset, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law. Liberty, so sought, is granted.

The writ petition stands dismissed as not pressed.
