The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 323, 324, 307, 504, 498A, and 506 of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act and charge-sheet has been submitted under Section 341, 323, 324, 307, 504, 498A and 506 of the Indian Penal Code.

As per prosecution case, the allegation against the petitioner is that he used to torture and beat the informant and ousted her from the home. It is further alleged that on 17.04.2023, the petitioner assaulted the mother of the

Patna High Court CR. MISC. No.62948 of 2023(2) dt.22-09-2023 2/3 informant by means of knife on her chest and stomach and when brother of the informant came to save her, the petitioner also assaulted him by means of knife and threatened the informant of dire consequences.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is husband of the informant and due to family dispute he has falsely been implicated in this case. The petitioner is ready to keep his wife/informant with proper honour and dignity. It is further submitted that as per impugned order, injury sustained by the injured is simple in nature. The petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 18.04.2023.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail.
